Our Terms & Conditions

We’re really not mad on small print, we simply try our very hardest to run our business in an honest, upfront and respectful manner!

However, so there’s no little misunderstandings and everything runs as smoothly as possible, we do have to have a few basic terms and conditions that we ask all clients to understand before booking a photoshoot with us. We wouldn’t expect you’ll read through them all so we’ve highlighted the most important points to note in white for you below!

In the following terms & conditions “the photographer” shall mean Andy Nickerson trading as Andy Nickerson Photography. “The client(s)” shall be those persons defined in the booking form or named on the invoice. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing. By booking with the photographer you agree to the below Terms and Conditions.

Booking Fees: A booking fee/deposit (if applicable) is taken to secure your time with us in the studio, please see our website for exact amounts. The booking fee will be invoiced to you once we have received your booking form and we’ve agreed a suitable date. This booking fee normally includes credit towards your final order.

Cancellation and Postponement: If the photographer has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. If the Client cancels the appointment an unconditional refund policy exists up until 7 days prior to the reserved booking time, after which point the full booking deposit will be retained by the photographer. Postponement: Should the cancelled appointment turn out to be a postponement due to illness, then, subject to the photographer’s discretion and availability, all monies paid may be applied to the new appointment. If, following cancellation by the client, a new date cannot be agreed by both parties, the full booking deposit will be retained by the photographer.

Creative Licence: The photographer shall be granted creative and artistic licence in relation to the choice of poses and retouching used. The photographer’s judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to the availability and willingness of subjects. The photographer will do his best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background or group arrangement.

Storage of Images After Your Photoshoot: All un-purchased photographs will be removed from our systems after a period of 28 days from the date of your photoshoot. After which time, if you have made no final order or made no reasonable attempt to reply to our correspondence, then we will presume that you no longer wish to make a purchase and therefore will be deleted from our computer systems. We safely retain digital copies of all purchased photographs for a minimum period of 12 months after your photoshoot.

Payments: Payment for all extra framed artwork or digital files, must be made at the time of ordering in advance of receipt of your order.

Prices: All services and/or goods are supplied at the current prices ruling at the time of supply and are subject to change without prior notice.

Fulfilment of Artwork/Digital Photographs etc: Unless otherwise agreed at the time of booking or at your viewing session, any products ordered (either framed artwork or digital photographs) will take up to 8 weeks to be complete from the date of your full payment. Physical products, such as delicate and heavy framed pieces, will require collection from our studio whereas digital photographs will be supplied via a secure cloud based service, usually Dropbox.

Retouching/Photoshop: The final output and finish of any image that is re-touched will be at the photographer’s soul discretion. Please make any specific requirements known before confirming your order.

Refund Policy: The photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print, framed print or in electronic format. No exception can be made as the photographer cannot be held responsible for individual tastes or exceptions. Once placed and paid for, artwork orders cannot be cancelled, changed or refunded in any way.

Liability: The photographer shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, our liability (if any) shall be limited to rectifying such defect. All products purchased are presumed to have been received in good condition unless the Client notifies the photographer in writing of any discrepancy or error within 14 days of receipt. All photographic products supplied by Andy Nickerson Photography are produced to the highest standards using the best quality materials and latest processing techniques. However, all photographs will, in time, fade. This is particularly true and can be accelerated if left in bright sunlight. The photographer cannot accept any responsibility for this gradual image deterioration.

Copyright: The 1998 Copyright, Designs, and Patents Act assign copyright to the photographer, unless at the time of booking a release is negotiated. By purchasing images in either print or digitally you are purchasing the right to the image, not the copyright and therefore have no rights to reproduce the image in or on any medium. You may not copy the photographs taken, or allow copies to be made photographically, electronically, or by any other means. This is a standard condition for professional photographers.

Display: The Photographer reserves the right for any photograph created during sessions to be displayed in the studio, portfolio, or in any other print or online advertising directly associated with Andy Nickerson Photography unless expressly agreed otherwise at the time of booking.

Privacy: Andy Nickerson Photography will store your name and address details on a private internal database. These details will not be made available to third parties. Complaints Procedure: Please address any complaints to Andy Nickerson Photography by email or writing as per our contact details. We will endeavour to respond to any complaint within 10 working days of receipt.

Law: These Terms and Conditions shall be governed and construed in accordance with the Laws of England.
